Summer of Sport Instagram giveaway T&Cs

  1. THE PROMOTER  
    1. The promoter is: DTV Services Limited (“Freeview”) with its registered office at Triptych Bankside, 6th Floor, 185 Park Street, London, England, SE1 9SH.
  2. THE GIVEAWAY  
    1. The title of the giveaway is Summer of Sport Giveaway.
    2. The giveaway provides the chance for one (1) person to win one (1) Hisense 43 Inch 43E7HQTUK Smart 4K UHD HDR QLED Freeview TV and one (1) personalised England Women’s Nike Home Stadium Shirt (together the “Prize”).
    3. Users must like the giveaway posts on Freeview’s and Caitlin and Leah’s Instagram pages, follow @freeviewtv, and @caitlinandleahh, and comment on each of the giveaway posts in Freeview’s and Caitlin and Leah’s Instagram pages with tagging one (1) friend.
    4. Users need to follow all the above steps for a successful entry.
    5. If users have a successful entry, they can get an extra entry by sharing to their story the giveaway post in Caitlin and Leah’s Instagram page and tagging @caitlinandleahh and @freeviewtv.
    6. Successful entries will then be entered into a pool and one (1) winner will be chosen at random by Freeview.
  3. HOW TO ENTER  
    1. The giveaway will run from 12:00pm on 31/07/2023 (the “Opening Date”) to 23:59pm on 06/08/2023 (the “Closing Date”) inclusive.
    2. All giveaway entries must be received by Freeview by no later than 23:59pm on the Closing Date. All giveaway entries received after the Closing Date are automatically disqualified.
    3. To enter the giveaway, you must see the giveaway post on Freeview’s Caitlin and Leah’s Instagram pages and do all the following:
      1. like the giveaway post on Freeview’s page and the giveaway post in Caitlin and Leah’s Instagram page;
      2. follow @freeviewtv and @caitlinandleahh on Instagram; and
      3.  comment and tag one (1) friend on the giveaway post on Freeview’s page and comment and tag one (1) friend on the giveaway post in Caitlin and Leah’s Instagram page (a set of comments in both posts is a new entry).
    4. You need to follow all the above steps for a successful entry.
    5. If you have followed all the steps on Paragraph 3.3 and you have a successful entry you can get an extra entry by sharing to your story the giveaway post in Caitlin and Leah’s Instagram page and tagging @caitlinandleahh and @freeviewtv.
    6. All successful giveaway entries will be entered into a pool and one (1) winner will be chosen at random by Freeview.
    7. No purchase necessary and there is no charge to register for use of the Instagram website.
    8. Freeview will not accept:
      1. responsibility for giveaway entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, but not limited to, as a result of equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
      2. proof of transmission as proof of receipt of entry to the giveaway.
    9. By submitting a giveaway entry, you are agreeing to be bound by these terms and conditions. 
  4. ELIGIBILITY  
    1. The giveaway is open to all residents in the UK (excluding the Channel Islands) aged sixteen (16) and over.
    2. Notwithstanding Condition 4.1, the giveaway is not open to:
      1. employees of Freeview or its holding or subsidiary companies;
      2. employees of agents or suppliers of Freeview or its holding or subsidiary companies, who are professionally connected with the giveaway or its administration; or
      3. members of the immediate families or households of 4.2.1 and 4.2.2 above.
    3. In entering the giveaway, you confirm that you are eligible to do so and eligible to claim the Prize. Freeview may require you to provide proof that you are eligible to enter the giveaway.
    4. Freeview will not accept giveaway entries that are automatically generated by computer, completed by third parties or in bulk.
    5. Freeview reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the Prize giveaway.
  5. THE PRIZE  
    1. The Prize includes one (1) Hisense 43 Inch 43E7HQTUK Smart 4K UHD HDR QLED Freeview TV and one (1) personalised England Women’s Nike Home Stadium Shirt. One (1) Prize is available to win.  
    2. Freeview reserves the right to substitute the Prize with another prize of equal or greater value.
    3. The Prize is not negotiable or transferable.
  6. WINNER  
    1. The decision of Freeview is final and no correspondence or discussion will be entered into.
    2. Caitlin and Leah will contact the winner personally via Instagram (@catlinandleahh) no more than two (2) days after the Closing Date. At this point Catlin and Leah will require the winner’s email address for further correspondence regarding delivering the Prize and the winner’s county and share this information with Freeview in order to comply with the obligation below.
    3. Freeview must either publish or make available information that indicates that a valid award took place. To comply with this obligation Freeview will send the surname and county of the Prize winner to anyone who emails [email protected] or messages the Freeview Instagram Page.
    4. By submitting a giveaway entry, you are agreeing to the use and publication of your surname and county in the manner described in 6.3 above.
    5. If you object to your surname and county being published or made available, please email Freeview at [email protected] prior to the Closing Date. In such circumstances, Freeview must still provide the information and winning entry to the Advertising Standards Authority on request.
  7. CLAIMING THE PRIZE  
    1. Please allow thirty (30) days for delivery of the Prize.
    2. The Prize may not be claimed by a third party on your behalf.
    3. Freeview will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed the Prize within two (2) days Freeview reserves the right to offer the Prize to the next eligible entrant selected at random from the successful entries received before the Closing Date.
    4. Freeview does not accept any responsibility if you are not able to take up the Prize or you provide incorrect address details for delivery of the Prize.
  8. LIMITATION OF LIABILITY  
    1. Insofar as is permitted by law, Freeview, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the negligence of Freeview, its agents or distributors or that of their employees. Your statutory rights are not affected.
  9. DATA PROTECTION AND PUBLICITY  
    1. Freeview will only process your personal information as set out in the Freeview Privacy Notice. See also Condition 6.3, Condition 6.4 and Condition 6.5, with regard to the announcement of winners.
  10. GENERAL  
    1. If there is any reason to believe that there has been a breach of these terms and conditions, Freeview may, at its sole discretion, reserve the right to exclude you from participating in the giveaway.
    2. Freeview reserves the right to hold void, suspend, cancel or amend the giveaway where it becomes necessary to do so.
    3. These terms and conditions shall be governed by English Law, and the parties submit to the exclusive jurisdiction of the courts of, England and Wales.
    4. If any court or competent authority finds that any provision of these terms and conditions (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of these terms and conditions shall not be affected.
